Supreme Constitutional Court rules widow’s pension rights cannot be transferred to heirs

Nicosia, Cyprus. The Supreme Constitutional Court ruled on Monday that the right to a widow’s pension is linked to the entitled person and cannot be transferred to heirs. The court dismissed an appeal seeking payment of the pension after the claimant’s death.


Court decision and appeal

The Law Office said the court dismissed an appeal in which the appellant had requested that social insurance services pay him a pension after his wife died, even though he was not eligible for the benefit.

Proceedings after the appellant’s death

The appellant appealed the decision at the administrative court but died while the case was pending. The administrator and heir of the property then asked to replace the deceased appellant in the proceedings.

Administrative court closure upheld

The administrative court ruled that the case ended with the appellant’s death. The administrator appealed that ruling, but the Supreme Constitutional Court upheld the decision and dismissed the appeal.
