Provo, United States. Judge Tony Graf is expected to rule on Tuesday whether there is sufficient evidence for Tyler Robinson to stand trial over the killing of conservative activist Charlie Kirk and whether prosecutors may seek the death penalty.


Hearing in Provo

The hearing is scheduled for 10 a.m. local time (1600 GMT) in Provo, Utah. Graf is expected to rule from the bench following up to four hours of closing arguments.

If the judge finds probable cause for a trial, an arraignment could follow, according to a Utah courts spokesperson. Robinson, 23, has not yet entered a plea.

Charges and evidence

Prosecutors accuse Robinson, a former electrical apprentice, of firing the single shot that killed Kirk, 31, while he debated students at Utah Valley University in Orem on September 10, 2025.

Robinson faces an aggravated murder charge, which carries the death penalty in Utah. Prosecutors allege the charge applies because others at the event were endangered.

During a week-long preliminary hearing in July, prosecutors presented what they described as overwhelming evidence, including test results they said showed Robinson’s DNA on the murder weapon.

Defense lawyers challenged the DNA testing and argued that police failed to investigate evidence suggesting another person may have carried out the killing.

Dispute over capital charge

Robinson’s attorneys have argued that the shooting was not a capital offence because the shooter struck the intended target and did not place anyone else at risk.

Prosecutors also allege that Robinson, who was in a relationship with roommate Lance Twiggs, targeted Kirk because of Kirk’s views against gay marriage and transgender rights. Prosecutors’ argument could support their pursuit of the death penalty.

Defense lawyers have said there is no evidence that Robinson disagreed with Kirk’s political views.

Kirk’s widow

Kirk was a co-founder of Turning Point USA and helped build support for President Donald Trump among young voters while aiding Republican voter-turnout efforts.

His widow, Erika Kirk, attended the July preliminary hearing and was expected to attend Tuesday’s session. She became chief executive and board chair of Turning Point USA after her husband’s death.

At a memorial following the shooting, Erika Kirk said she forgave the alleged shooter. She has not commented on the death penalty charge.
