Cyprus non-dom: who may qualify and what changes
The relationship between tax residence and domicile, core exceptions, deemed domicile, SDC and evidence without promises of automatic savings.

In brief: Non-dom concerns domicile for Special Defence Contribution. It is not an immigration permit, citizenship or a substitute for tax residence. First determine Cyprus tax residence for the year, then domicile and any exception on the individual facts.
Two different tests
Tax residence asks whether the person is a Cyprus resident in a particular tax year; domicile is a separate concept used for SDC. Sixty or 183 days therefore do not create or prove non-dom on their own. Establish domicile of origin, any legally effective change and the residence history instead of treating the status as an elective box.
When an exception may apply
Official guidance describes circumstances in which a person with a foreign domicile of origin, or certain people of Cyprus origin, may be treated as not domiciled. A deemed-domicile rule also applies by reference to a long tax-residence history, including 17 of the preceding 20 years. Exceptions and transitional rules must be mapped to the exact chronology.
The SDC effect
The status affects Special Defence Contribution on specified passive-income categories, but does not automatically remove income tax, GESY, filing or tax in other countries. Rates changed in 2026 and an alternative mechanism was introduced for certain people approaching deemed domicile. Use current legislation and the official form, not a historic summary.
Supporting the position
Collect birth and family records, wills and other domicile facts, the complete tax-residence history, certificates and returns. Classify income by type, source and date. A written position from a licensed tax adviser should explain the facts, law, duration and what happens if circumstances change, not merely announce a beneficial conclusion.

Three concepts that must not be confused
Tax residency determines where a person is taxed as a resident; domicile is a separate legal concept; ‘non-dom’ is a practical term denoting exemption from part of the SDC, subject to certain conditions. None of these constitutes a residence permit.
Domicile of origin is usually linked to circumstances of birth and parentage, but may change according to complex rules. A passport and place of birth do not provide a complete answer. A person returning to Cyprus requires particularly careful analysis.
The law also takes into account long-term tax residency over a specified period. Count the years based on official records, not from memory. A gap or an incomplete year may be significant; this is assessed by a specialist.
What types of income are covered by this question?
Non-dom status is often discussed in relation to dividends and interest, but specific income must first be classified. Payments to a company owner, salaries, fund distributions and capital gains are subject to different rules. The name of a banking transaction does not determine the tax liability.
Exemption from SDC does not mean exemption from income tax, GESY, withholding tax or the rules of another country. Draw up a tax map for each income stream and check the agreement. A zero tax liability must have a legal basis.
Structures involving a company, a trust or multiple countries require analysis of beneficial ownership, control and anti-avoidance provisions. Do not set them up solely on the basis of a marketed scheme. The costs and disclosure requirements may outweigh the anticipated benefits.
How to confirm status
Gather evidence, family history, previous places of permanent residence and your intention, where relevant. Documents must explain the chain of events, not just your current address. Contradictory statements across different countries increase the risk.
Tax certificates and the non-dom form have their own procedures. Check that the version is for the correct year, and verify the signature and attachments. The representative prepares a written conclusion, setting out the facts and assumptions.
Keep a record of the submission confirmation and calculations. If circumstances change, the previous conclusion is reviewed. Marriage, return to the country, length of residence and a change in centre of life may affect the analysis.
Annual review
At the start of the year, list your expected income, source countries and major events. Before any payments are made, check withholding tax and reporting requirements. It is more difficult to adjust the structure after income has been distributed than to determine the category in advance.
Check actual days spent and tax residency separately from domicile. If residency has not been established, discussing non-dom status may be premature. In cases of dual residency, resolve the treaty issue first.
