In brief: Obtain a written draft lease and confirm who is entitled to let the property before paying a deposit. Legal protection depends on the premises, its history, the nature of occupation and the contract, so a universal claim about every tenant’s rights can be misleading.

Checks before reserving

Inspect the home in person or by live video, match the address to the recipient of funds, and request evidence of ownership or the agent’s authority. Check the term, furniture, parking, pets, early exit and use of the address. Do not transfer money solely on the strength of an image of a document or a chat message; verify the property and payment details independently.

Terms to put in writing

Identify the exact premises and parties, term, rent, payment date, deposit amount and purpose, repair responsibilities, included bills and notice procedure. Attach an inventory with photographs, meter readings and the number of keys. State how the deposit will be returned and which deductions are permitted; an oral promise is difficult to prove after departure.

Bills and handover

Establish whose name appears on electricity, water, internet, municipal and common-building charges. EAC requests a rental or sale agreement and identification for a transfer of supply, with a tenant deposit. Sign a move-in record, retain receipts and do not accept a previous occupier’s debt as yours without a clear written basis.

When a dispute develops

Send a dated written notice stating the precise remedy and a reasonable response period. The Rent Control Tribunal handles matters falling within the Rent Control Law; other contractual disputes may belong elsewhere. Do not withhold the final rent or change locks without advice on the specific contract and facts.

Practical checklist

  • verify the property, owner and agent authority;
  • record every sum and deadline in writing;
  • sign the inventory, photographs and meter readings;
  • obtain a receipt for every payment;
  • retain the contract and correspondence after leaving.

Verification of the parties and the property

Establish who is signing the contract and on what basis the property is being let. The name of the person receiving the money must be substantiated by documents. The agent must show proof of authorisation, whilst the company representative must demonstrate their signing authority. Do not transfer the deposit simply for the removal of the advert.

Inspect the address, condition, furniture, water, electricity, air conditioning, locks and communal areas. Enquire about damp, noise, parking and building regulations. Save the photographs from the advert, but document the condition using a separate, signed inventory.

Check whether guests, pets, working from home and registering your address are permitted. Verbal agreements must be included in the contract if they are important to the decision. Otherwise, it will be difficult for the parties to prove that they share the same understanding.

Terms that must be explicitly stated

The contract specifies the property, the parties, the term, the rent, the payment date, the deposit and its purpose. Specify separately any included bills, shared costs, rent indexation, repairs, the landlord’s access rights and the notice period for termination.

The security deposit should not be described in a single word. Set out the conditions for its return, permissible deductions, the timeframe and the method of calculation. Distinguish between normal wear and tear and damage, and support any disputed deductions with documentation.

In the case of a joint tenancy, define each person’s responsibilities and the consequences of one person moving out. Internal agreements between flatmates do not alter their obligations to the landlord if the tenancy agreement stipulates joint and several liability.

Handover and Tenancy Period

On the handover date, record the meter readings, the number of keys and any defects. Have both parties sign the inventory and keep the original photo files. Report any hidden issues in writing immediately upon discovery.

Pay using a method that clearly states the purpose of the payment and obtain a receipt. Cash payments without proof complicate disputes. Do not withhold rent yourself on the grounds of repairs without a legal assessment and the prescribed procedure.

A repair request must include the date, a description, photographs and the impact on the use of the property. In the event of an accident, use the agreed point of contact and ensure the safety of people and property. Agree in writing beforehand on any work you carry out yourself and the compensation for it.

Moving out without losing evidence

Send notice in accordance with the time limit and method specified in the tenancy agreement. Arrange an inspection, take final meter readings and return all keys against a signed receipt. Do not leave any property behind without a written agreement on its disposition.

Compare the final condition with the initial inventory, rather than relying on the parties’ recollections. Request a breakdown of each deduction and proof of expenses. If a dispute remains, use the designated channel and seek independent legal advice.

Keep the contract, payment records, correspondence and the handover report after you have moved out. This article provides a framework for checking the tenancy, but specific rights depend on the contract and the law. It is best to postpone signing any text you do not understand until you have obtained an independent translation or sought advice.

Draw up a separate list of disputed points: exactly what is changing, who confirmed the change, and in which version of the contract it appears. Such a log is more useful than lengthy correspondence without any conclusions and allows you to check, before signing, that none of the agreed terms have been omitted from the final document.
