Nicosia, Cyprus. The European Court of Human Rights (ECtHR) has notified Cyprus of part of former auditor-general Odysseas Michaelides’ appeal concerning an alleged violation of his right to freedom of expression.

Michaelides said the notification relates to Article 10 of the European Convention on Human Rights and does not prejudge the admissibility of the case or the court’s final ruling.

Questions before the court

In a post on X, Michaelides described the development as positive, saying it concerned what he called the core of his case: whether his removal from office violated his freedom of expression in relation to public statements and actions on matters of public interest while carrying out his duties.

He said the ECtHR had raised two questions for examination. The first is whether his dismissal constituted interference with his freedom of expression.

The second is whether any such interference was provided for by law, pursued a legitimate aim and was necessary in a democratic society.

Michaelides also said his dismissal could have broader implications for the willingness of officials to speak publicly while performing institutional roles.

Dismissal in 2024

Michaelides filed the appeal following his dismissal by the Supreme Constitutional Court in September 2024.

An eight-judge panel unanimously found that he had conducted himself inappropriately and was unfit to continue serving as auditor-general.

The court’s judgment focused on his conduct in office, particularly repeated disputes with attorney-general George Savvides. It found that Michaelides had repeatedly sought to undermine legal opinions issued by Savvides, including by presenting legal interpretations that contradicted those of the attorney-general.
